David has practiced in the Conasauga Judicial Circuit (Whitfield and Murray Counties) for over 30 years. Whitfield (Dalton) and Murray (Chatsworth) counties comprise the hub of the flooring industry. The flooring industry creates a much greater volume of business litigation for Dalton than most communities its size. David has handled carpet related litigation involving everything from a lien on a few rolls of carpet to international disputes. Most business disputes fall under one of the following categories:

1) Contract Disputes: Business entities often have disagreements over the terms of contracts. Those disputes touch on almost every conceivable type of good or service from information systems to personnel to raw materials. Many of those disputes involve the application of the Uniform Commercial Code (UCC) or the Uniform Voidable Transfer Act (formerly known as the Uniform Fraudulent Conveyance Act)

2) Financing/Liens: In down business cycles many questions arise over lien creation and lien priority. Both borrowers and lenders often find themselves in litigation. Inevitably, many issues arise in conjunction with foreclosure. David has addressed these issues in a variety of contexts.

3) Disputes Between Business Partners: Dalton and Chatsworth are teeming with small businesses both in and out of the flooring industry. Inevitably, principals of these businesses have disputes over control, compensation, accounting and a host of other issues. The issues tend to remain the same whether the entity involved is a partnership, limited liability company (LLC), corporation, or other arrangement. Unfortunately, litigation is sometimes the only way to resolve the dispute.
